You retain all rights to the images you upload and generate through the AI photo editor. Generated images and their copyright belong to you. By uploading or generating content on our platform, you grant us a limited license to process, store, and display your images solely for the purpose of providing our services.

3.2. Prohibited Content

Users are strictly prohibited from uploading any content that contains nudity, violence, or any material that is unlawful in the United States. We reserve the right to remove any content that violates these terms, and we may terminate accounts found to be in breach of our content policy.

4. AI Usage and Limitations

Our service uses advanced AI technology to edit photos. However, the nature of AI means that results may vary, and the final output may not always meet your expectations. The Service is provided on an "as-is" basis, without any warranties or guarantees regarding the accuracy, quality, or functionality of the results.

5. Payment, Fees and Refunds

Some features of the Service may require payment. Prices are subject to change at any time. You agree to pay all fees and applicable taxes incurred through your use of our services.

No Refunds: All image generations are final, and no refunds will be provided for image generation services under any circumstances.

6. Account Termination

We reserve the right to terminate or suspend your account for any reason, including but not limited to:

• Violations of these terms.
• Malicious or abusive behavior.
• Uploading or creating prohibited content.

We may also terminate your account at our discretion if deemed necessary to protect the platform or its users.

7. Privacy and Data Collection

We store user-uploaded images for a period of 30 days in our secure AWS S3 storage. After 30 days, the images will be permanently deleted from our systems. For more information about how we handle your personal data, please refer to our Privacy Policy.

We collect certain user data necessary to provide the service, such as images uploaded for editing and usage analytics.

8. Intellectual Property

The technology, AI models, algorithms, and software that power www.imgbox.ai are the intellectual property of the platform. You may not copy, modify, distribute, or reverse-engineer any aspect of the Service without prior written consent. All branding, logos, and marks are the property of www.imgbox.ai and protected under intellectual property laws.

9. Disclaimers and Limitation of Liability

www.imgbox.ai is provided on an "as-is" and "as available" basis. We make no warranties or guarantees about the reliability, accuracy, or completeness of our services, and we disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.

Under no circumstances will www.imgbox.ai be liable for any indirect, incidental, or consequential damages (including but not limited to loss of data, profits, or reputation) arising from the use or inability to use the Service.

This ToS is governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under or related to this agreement will be resolved through binding arbitration in Austin, Texas. Both parties are required to attend the arbitration in person.
